In 29 years of notary practice in Deira, the single most common documentation mistake we see is using the wrong type of Power of Attorney. Clients prepare the document, pay for notarization, wait for attestation, and then find the document is not accepted at the DLD counter or handed back by the other party's lawyer.

The distinction between a General POA and a Special POA is not a technicality. It is a fundamental difference in how much authority you are granting and to what scope. Courts and government bodies in the UAE check this carefully before acting on any POA.

What Is a General Power of Attorney (GPA)?

A General Power of Attorney grants your chosen attorney broad, wide-ranging authority to act on your behalf across most legal, financial, and personal matters. The attorney can sign contracts, manage bank accounts, deal with government entities, buy or sell assets, and represent you in legal proceedings, all under one document.

When a General POA makes sense:

  • You are relocating abroad for an extended period and need someone to manage all your UAE affairs
  • A trusted family member needs to handle everything (utility bills, bank operations, vehicle renewals, rental management) on your behalf
  • You are setting up a business and want a partner to have full authority to act for the company

Important caution:

UAE courts scrutinize General POAs carefully, precisely because they grant so much authority. If a dispute arises about whether an action was authorized, the burden falls on the grantor to prove the attorney exceeded their authority. Most UAE government bodies, especially DLD for property transactions, actively prefer Special POAs and will often not accept General ones for specific transactions.

What Is a Special Power of Attorney (SPA)?

A Special Power of Attorney is limited in scope; it authorizes the attorney to perform one specific act or a defined set of related acts. Once that act is completed, the POA has served its purpose and has no further legal effect.

Typical uses for a Special POA:

  • Sell a specific apartment (Unit 704, Marina Heights, Dubai Marina) on your behalf
  • Register a specific vehicle (plate number AB 12345) at RTA
  • Sign a specific commercial contract with a named party
  • Represent you in a specific court case
  • Complete a mortgage registration for a specific property

Our recommendation:

When in doubt, use a Special POA. It is safer for you as the grantor, and it is what most UAE government bodies prefer to see. The only scenario where a General POA is clearly better is when you genuinely need someone to handle a wide range of ongoing tasks over an indefinite period.

Which POA Does DLD (Dubai Land Department) Accept?

This is where clients most often get it wrong. The Dubai Land Department requires a Special POA for all property transactions. Full stop.

The DLD checks the POA before processing any sale, purchase, mortgage, or lease registration. Their requirements are specific:

  • Full name and passport/Emirates ID number of the grantor (property owner)
  • Full name and passport/Emirates ID number of the grantee (attorney)
  • Specific property identified by plot number, building name, and unit number
  • Specific transaction stated clearly: 'to sell', 'to purchase', 'to mortgage', 'to lease'
  • Transaction value stated (for sale transactions)
  • The POA must be notarized at Dubai Courts; private notarization alone is not accepted

A General POA presented at the DLD for a property sale will almost always require a compliant Special POA instead. We have seen this happen to clients who had their documents prepared elsewhere without proper DLD-specific guidance.

Which POA Does RTA Accept for Vehicle Transfers?

The Roads and Transport Authority (RTA) accepts a Special POA for vehicle ownership transfers. The document should specify:

  • The vehicle clearly identified by plate number, chassis number (VIN), or both
  • The specific transaction: 'to transfer ownership', 'to sell', or 'to register'
  • The name of the attorney who will appear at the RTA service center

Which POA Do Banks in UAE Require?

This varies by bank and by transaction type. Here is what we have observed in practice:

ADCB, Emirates NBD, FAB

These banks generally accept a notarized General POA for standard account management, checking balances, receiving transfers, managing standing orders. However, for large transactions (above account-specific thresholds) or for loan-related matters, they typically require the account holder to appear in person or have a branch manager approve the POA.

Banks with proprietary POA forms

Some banks, particularly for investment accounts or NRI banking relationships, have their own standard POA forms. If your bank provides a form, use it. We can notarize the bank's own form at Dubai Courts, which is exactly what is required. Bring the bank's blank form to our office and we will guide you through completing and notarizing it.

Crypto / digital asset firms

These entities typically do not accept POAs at all; they require direct identity verification. A POA will not help you access someone else's crypto account.

What Happens If You Use the Wrong Type?

The question we get asked every day by clients who come to us after a rejection: "Can I just add something to the existing POA?" The answer is no, and the consequences of getting it wrong are real.

The DLD counter staff will return the document for a compliant replacement. You lose the appointment slot and may lose your place in a time-sensitive transaction.

The other party's lawyer will flag the wrong POA type. In a property sale, this can cause the buyer to pull out, especially if they have a financing deadline.

You must revoke the original POA, prepare a new one, re-notarize, and (if it is for use abroad) re-attest through the full chain. This means additional cost and 1–2 weeks of delay.

Real example from our practice:

A client came to us after spending AED 800 on a General POA at another office for a property sale in Business Bay. The DLD returned it on the spot because it did not specify the plot number or transaction value. He had already paid a buyer a deposit and the sale was at risk. We prepared a compliant Special POA the same afternoon; he signed it, we submitted to Dubai Courts, and the sale proceeded. The cost of getting it wrong the first time: AED 800 wasted plus two days of stress.

Can a POA Be Changed After It's Notarized?

No. A notarized POA cannot be amended, corrected, or extended. Once it is stamped and sealed, the document is final.

If you need to change the scope, extend the validity, or correct an error, the process is:

  1. 1Revoke the original POA: this requires a notarized Revocation of Power of Attorney at Dubai Courts. Fee: approximately AED 100–200.
  2. 2Notify anyone who was relying on the original POA (the attorney, any third party like the DLD or a bank) that it is revoked.
  3. 3Prepare and notarize a new POA with the correct details.

This is why we spend time with every client to get the details right before drafting. A five-minute conversation at the start saves AED 800 and a week of delay at the end.

Frequently Asked Questions

Can I convert a General POA into a Special POA without getting a new one?

No. Once a POA is notarized, its scope is fixed. You cannot narrow a General POA into a Special one; you must revoke the General POA and issue a new Special POA. The revocation must also be notarized at Dubai Courts, and notice should be given to anyone who was relying on the original POA. In practice, we always recommend clients think carefully about scope before signing, because amendments mean additional time and cost.

Does a Special POA expire automatically after the transaction is completed?

In UAE law, a Special POA is generally considered spent once the specific act it authorizes has been completed. For example, if your Special POA authorizes the sale of a specific apartment and that sale is registered, the POA has served its purpose and has no further legal effect. However, we recommend including an explicit expiry clause anyway, typically 12 months from the date of notarization, to prevent any ambiguity if the transaction is delayed or disputed.

My employer wants me to sign a General POA for company use. Is that normal?

This is not a standard practice and we would advise caution. A General POA grants very broad authority, and signing one in favor of an employer or business partner exposes you to significant risk if the relationship sours. In most legitimate business scenarios, a company should use a Special POA limited to the specific transaction or contract at hand. If an employer is pressing for a General POA with no clear legal justification, we recommend consulting with a legal adviser before signing.

My POA was not accepted by the DLD: what are my options?

First, find out the exact reason the document was not accepted; DLD staff will usually tell you at the counter. The most common reasons are: wrong POA type (General when Special is required), missing property details (no plot number or building name), expired POA, or the POA was not notarized through the correct UAE process. In most cases, you need a new POA rather than an amendment. Come to our office with the details and we will draft a compliant replacement, often on the same day.
